We understand that each person that seeks assistance has a unique financial situation. During your pre-filing counseling session, a certified credit counselor will work one-on-one with you to develop a detailed personal financial assessment. Your counselor will review your income, expenses, assets, and liabilities. This in-depth process will provide you with a true and accurate picture of your financial situation. The personal financial assessment is just the first piece that is developed to help you determine the right solution for your financial situation. Your counselor will work with you to develop a reasonable and manageable spending plan, a detailed action plan, and short and long-term financial goals.
In-person and telephone pre-filing counseling sessions are available Monday through Friday, 8am to 5pm from our local offices in Topeka or Lawrence Kansas by appointment only. After hours or emergency appointments are available by request.
Upon completion of the counseling session, HCCI is obligated to promptly issued a certificate of participation that allows you to proceed with the bankruptcy filing process. Timely certificate delivery is offered by email, fax, or mail.
Bankruptcy Counseling clients who have an annual gross income below 150% of current Federal Poverty Guidelines are presumed to be entitled to a fee waiver.
HCCI should initiate the required counseling session in the same manner whether a fee is paid or not. If HCCI can demonstrate that the individual has the ability to pay (based on income information the individual submits), HCCI may charge a reduced fee of $25, this is called a “rebuttable presumption”.
